United Tribe of Shawnee Indians

Congressional Act (THRITY-FIFTH CONGRESS. Sess. II. Ch. 83. 1859) for the Issue of Patents to the United Tribe of Shawnee Indians Indian Country Treaty Lands under the United Tribe of Shawnee Indian treaty of 1854 as follows:

SEC. 11 And be it further enacted, That in all cases where, by the terms of any Indian treaty in Kansas Territory, said Indians are entitled to separate selections of land, and to a patent therefor, under guards, restrictions, or conditions for their benefit, the Secretary of the Interior is hereby authorized to cause said patnts therefor to issue to such Indian or Indians, and their heirs, upon such conditions and limitation, and under such guards or restictions as may be prescribed by said Secretary: ProvidedThat nothing herein contained shall be considered to apply to the New ork Indians, or to affect their rights under the treaty made by them in eighteen hundres and thirty-eight at Buffalo Creek.

Shawnee Reserve Number 206 Patent

THE UNITED STATES OF AMERICA

To all to whom these presents shall come, greeting:

Whereas, under the provisions of the 2d and 9th Articles of the Treaty concluded on the 10th day of May, A. D. 1854, between the Commissioners on the part of the United States and Delegates of the United Tribe of Shawnee Indians, certain members of said tribe became entitled, out of the lands ceded by said Treaty, "if a single person" to "two hundred acres, and if the head of a family, a quantity equal to two hundred acres for each member of his or her family," and to a patent therefore, upon provision being made by Congress for the issuing of the same: which has been done by the 11th Section of the Act of Congress, approved 3d March, 1859; (U.S. Statutes, Vol. 11, page 430).

AND WHERESE, it appears from "Reservation, Book C," accompanying a Return, dated November 6th, 1857, from the Office of Indian Affairs, to the General Land Office, that there have been located and approved, as the selection for Newton McNeer the head of a family consisting of himself and Nancy McNeer, the following described tracks of land, to wit: The East half of the South West quarter of Section Twenty Five (80) acres. The North West quarter of the South West quarter of Section Twenty Five (40 acres). The South half of the South East quarter of Section Twenty Five (80 acres) in Township Twelve South of Range Twenty Two East. The North half of the South East quarter of Section Twenty Five (80 acres). The East half of the North East quarter of Section Twenty Five (80 acres). The North West quarter of the North East quarter of Section Twenty Five (27.30 acres) in Township Twelve South of Range Twenty Two East of the Sixth Principal Meridian in Kansas containing in the aggregate Three hundred and Eighty Seven acres and thirty hundredths of an acre.

NOW KNOW YE, That the United STATES OF AMERICA, in consideration of the premises, and in accordance with the directions of the Secretary of the Interior, under the aforesaid 11th Section of the Act of Congress of March 3d, 1859, HAVE GIVEN AND GRANTED, by these presents DO GIVE AND GRANT, unto the said Newton McNeer as head of the family aforesaid the tracks of land above described; but with the stipulation describes by the Secretary of the Interior, under the Act of Congress aforesaid, of March 3d, 1859, that said tracks "shall never be sold or conveyed," by the Grantee or his heirs, "without the consent of the Secretary of the Interior for the time being,

TO HAVE AND TO HOLD the said tracks of land, with appurtenances, unto the said Newton McNeer as head of the family as aforesaid and to his heirs and assigns forever, with the stipulation aforesaid.
